1. Introduction

Welcome to Cineriot (the "Platform"), a service provided by Petacrate Technologies Pvt Ltd ("Company," "we," "us," or "our").

Our Platform is a unique ecosystem designed for the movie and entertainment industry. It blends social networking with professional opportunities, allowing users ("you," "User," or "Member") to showcase their talent, connect with industry peers, discover jobs, and participate in movie creation.

By accessing or using our Platform (including our mobile application, website, and related services), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legally binding contract between you and Petacrate Technologies Pvt Ltd.

If you do not agree to these Terms, you must not access or use our Platform.

2. Who Can Use Our Services (Eligibility)

We want our community to be professional, safe, and secure. To use our Platform, you must meet the following criteria:

  • Age Requirement: You must be at least 18 years old. Access by anyone under 18 is strictly prohibited.
  • Legal Capacity: You must have the full power and authority to enter into this agreement and not be barred from doing so under any applicable laws.
  • No Sex Offenders: You must not be a convicted sex offender.
  • Account Status: You must not have been previously disabled or banned from using our Platform for violation of our laws or policies.

3. Your Account and Responsibilities

3.1 Account Security

You are responsible for safeguarding your account. You agree not to share your login details &otp's, let others access your account, or transfer your account to anyone else. You are responsible for all activities that happen under your username.

3.2 Prohibited Activities (How You Cannot Use the App)

You agree NOT to engage in the following conduct:

  • Impersonation: You cannot impersonate others or provide inaccurate information.
  • Unlawful Use: You cannot use the Service for any illegal or unauthorized purpose, including violating the Information Technology Act, 2000 or copyright laws.
  • Buying/Selling Data: You cannot attempt to buy, sell, or transfer any aspect of your account (including your username) or solicit, collect, or use login credentials or badges of other users.
  • Unauthorized Access/Scraping: You cannot access or collect data from our Platform using automated means (scrapers, robots, spiders) without our prior permission.
  • Interference: You cannot upload viruses, malicious code, or do anything that could disable, overburden, or impair the proper working of our Platform.
  • Reverse Engineering: You cannot modify, translate, create derivative works of, decompile, or reverse engineer our products or their components.
  • Username Squatting: You cannot use domain names or URLs as your username without our written consent.

3.3 Community Guidelines

Under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not host, display, upload, modify, publish, transmit, store, update, or share any information that:

  • Belongs to another person and to which you do not have any right.
  • Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, insulting or harassing on the basis of gender, or racially/ethnically objectionable.
  • Is harmful to children.
  • Infringes any patent, trademark, copyright, or other proprietary rights.
  • Threatens the unity, integrity, defense, security, or sovereignty of India.

4. Permissions You Give Us

4.1 Usage License

You own the content you create and share on Cineriot (such as photos, videos, audition tapes, and posts). However, to provide our Services, we need you to give us some legal permissions (known as a "license").

By posting content, you grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content.

  • Example: If you post a movie clip, we have permission to store it, display it to your followers, and resize it for different screens.

Termination of License: This license ends when your content is deleted from our systems. However, you acknowledge that:

  • Deleted content may persist in backup copies for a reasonable period (typically up to 90 days, or longer if required by law).
  • Content you have shared with others (e.g., via direct message or resharing) may continue to be visible if they have not deleted it.
  • We may retain content for legal compliance or valid law enforcement requests.

4.2 Permission to Use Your Name, Likeness, and Voice

As this is a movie-industry focused platform, you grant us permission to use your username, profile picture, and information about your actions (such as likes or job applications) in connection with accounts, ads, and sponsored content that we display across our products, without any compensation to you.

4.3 Use of Feedback

We appreciate your feedback and suggestions. If you choose to submit them, you agree that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.

5. Our Rights

5.1 Platform Intellectual Property

All rights, title, and interest in and to the Platform (excluding User Content) are and will remain the exclusive property of Petacrate Technologies Pvt Ltd and its licensors. This includes our logos, source code, and "look and feel."

5.2 Username Rights and Availability

We reserve the right to remove, reclaim, or force forfeiture of any username for any reason. This includes, but is not limited to, instances where a username violates a third party's intellectual property rights (such as trademark infringement), is used to impersonate another person or entity, is misleading, or is being "squatted" upon for the purpose of resale. You do not own your username; it is a licensed identifier provided by the Platform.

5.3 Content Removal & Account Termination

We can remove any content or information you share on the Service if we believe that it violates these Terms of Use, our policies, or we are permitted or required to do so by law. We may immediately suspend or permanently disable your access to the Platform if:

  • You clearly, seriously, or repeatedly breach these Terms.
  • We are required to do so for legal reasons.
  • Your account creates risk or legal exposure for us or other users.

6. Funding and Services

6.1 Ads and Sponsored Content

Our Platform is currently funded by advertising. You agree that we can show you ads that businesses and organizations pay us to promote. We use your personal data to show you ads that are relevant to you. (Please refer to our Privacy Policy for details on how we use your data).

6.2 Subscriptions and Premium Services

We MAY offer subscription-based or premium services in the future ("Premium Services"). If we do:

  • Use of Premium Services will be subject to additional terms and fees.
  • We reserve the right to change our fee structure at any time with notice to you.

7. Disclaimers and Limitations of Liability

7.1 "As Is" Service

TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL ALWAYS BE SAFE, SECURE, OR ERROR-FREE, OR THAT IT WILL FUNCTION WITHOUT DISRUPTIONS.

7.2 Intermediary Status

We act as an "Intermediary" as defined under the Information Technology Act, 2000. We are not the publisher of user-generated content and are not liable for any content posted by you or other users. You are solely responsible for the content you post.

7.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PETACRATE TECHNOLOGIES PVT LTD SHALL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS, REVENUES, INFORMATION, OR DATA, OR CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, PUNITIVE, OR INCIDENTAL DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7.4 Professional Interactions & Casting Disclaimer

> Cineriot is a platform for discovery, not a talent agency or employer. We do not perform background checks on all users. You acknowledge that any meeting, audition, or contract resulting from the use of the Platform is at your own risk. The Company is not responsible for the safety, conduct, or payments of third parties. Always verify the identity of a recruiter and never attend auditions in private residential locations.

8. Dispute Resolution and Governing Law

8.1 Governing Law

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of India.

8.2 Exclusive Jurisdiction

You agree that any legal suit, action, or proceeding arising out of or related to these Terms or the Platform shall be instituted exclusively in the courts located in Hyderabad, Telangana, India. You waive any and all objections to the exercise of jurisdiction over you by such courts.

8.3 Force Majeure

The Company shall not be liable for any failure to perform its obligations where such failure results from any cause beyond the Company's reasonable control, including, but not limited to, electronic, or communication failure or degradation.

9. Updating These Terms

We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you (for example, through our Service) before we make changes to these Terms.

If you continue to use the Service after the updated Terms have been posted, you will be binding yourself to the updated Terms. If you do not want to agree to these or any updated Terms, you can delete your account.

10. Intellectual Property & Takedown Policy

We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Information Technology Act, 2000, we have established the following process for reporting infringement:

  • Notice of Infringement: If you are a trademark or copyright owner and believe your rights are being violated on the Platform, you must submit a formal notice to our Grievance Officer.
  • Required Information: Your notice must include: (a) a description of the protected work; (b) the specific username or URL of the infringing content; (c) your contact information; and (d) a statement that the information in your notice is accurate.
  • Our Action: Upon receipt of a valid legal notice, we will act expeditiously to remove or disable access to the infringing material. We may also permanently ban repeat offenders.
