END USER LICENSE AGREEMENT (EULA)

1. Acknowledgment

This End User License Agreement ("Agreement") is a binding legal agreement between Petacrate Technologies Pvt Ltd ("Company," "we," "us," or "our") and you ("User" or "you"). By downloading, installing, or using the Cineriot mobile application ("Application"), you agree to be bound by this Agreement.

For iOS Users: You and the Company acknowledge that this Agreement is concluded between you and the Company only, and not with Apple Inc. ("Apple"). The Company, not Apple, is solely responsible for the Application and the content thereof.

2. Scope of License

Subject to your compliance with this Agreement, the Company grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Application for your personal, non-commercial use on a mobile device owned or controlled by you.

For iOS Users: Use of the Application is limited to Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

3. License Restrictions

You agree not to, and you will not permit others to:

  • License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose, or otherwise commercially exploit the Application.
  • Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works from any part of the Application.
  • Remove, alter, or obscure any proprietary notice (including copyright or trademark notices) of the Company.

4. Content and Objectionable Behavior (Zero Tolerance)

As a social and professional platform, we maintain a Zero Tolerance Policy regarding objectionable behavior.

  • Content Moderation: You agree not to upload, post, or transmit any content that is offensive, hateful, pornographic, illegal, or violates our Community Guidelines.
  • Synthetic Content (AI): If you upload content significantly altered or generated by AI ("Deepfakes"), you must clearly label it. Failure to do so results in an immediate ban.
  • Action: The Company will act on reported content involving nudity or safety violations within 24 hours. We reserve the right to remove content and eject users without prior notice.

5. User Interactions and Assumption of Risk

You acknowledge that the Application enables interaction with other users for professional opportunities.

  • No Vetting: The Company does not verify user identities, credentials, or conduct background checks.
  • Your Risk: Any interaction or meeting—online or offline—is undertaken at your own risk. The Company is not liable for disputes, fraud, or harassment arising between users.

6. Updates and Maintenance

The Company may provide enhancements, bug fixes, or modifications ("Updates"). These may be mandatory for continued use.

No Apple Responsibility: You and the Company acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

7. Effect of Termination

The Company may suspend or terminate your access at any time for violation of this Agreement. Upon termination, the license shall immediately end, and you must cease all use of the Application.

8. Warranty Disclaimers

THE APPLICATION IS PROVIDED TO YOU "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND.

For iOS Users: In the event of any failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.

9. Limitation of Liability

To the maximum extent permitted by law, Petacrate Technologies Pvt Ltd shall not be liable for any indirect, incidental, or consequential damages. The Company's total aggregate liability shall not exceed the amount paid by you to the Company in the last 12 months, or INR 1,000, whichever is higher.

10. Product Claims

You and the Company acknowledge that the Company, not Apple, is responsible for addressing any claims relating to the Application, including product liability, legal/regulatory requirements, or consumer protection claims.

11. Intellectual Property Rights

You acknowledge that in the event of any third-party claim that the Application or your use of it infringes a third party's intellectual property rights, the Company, not Apple, will be solely responsible for the investigation, defense, and settlement of such claims.

12. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from any claims, losses, or expenses (including legal fees) arising out of your use of the Application, your violation of this Agreement, or any content you post.

13. Legal Compliance

You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

14. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application (e.g., your wireless data service agreement).

15. Third-Party Beneficiary (Apple)

You and the Company acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement. Upon your acceptance, Apple will have the right to enforce this Agreement against you as a third-party beneficiary.

16. Severability

If any provision of this Agreement is held to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

17. Governing Law and Jurisdiction

This Agreement is governed by the laws of India. Any disputes arising out of or related to this Agreement shall be resolved exclusively in the courts located in Hyderabad, Telangana, India.
